The eighth edition of this widely used handbook provides a clear, accessible, and distinctive introduction to comparative constitutional law through the lens of democratic constitutionalism and the rule of law. Rather than taking the constitutional law of one country as its starting point and comparing other systems only as points of reference, the book identifies fundamental constitutional features, institutions, and problems and examines them through a consistent comparison of six constitutional systems: the United States, Germany, the United Kingdom, France, the Netherlands, and the European Union. These systems share a broadly common grammar of representative democracy, legality and the rule of law, fundamental rights, and limited government, while embodying markedly different constitutional traditions and institutional choices. For each principal area of constitutional law, the book provides a general introduction and comparative overview, followed by detailed sections explaining how the issue is addressed in each of the six systems. The eighth edition retains this established structure while substantially renewing and broadening the book’s analysis. Alongside constitutions, treaties, legislation, and case law, it gives greater attention to the working constitution: the conventions, institutional practices, political culture, and behaviour of constitutional actors that determine how legal rules operate in practice. It examines constitutional government against the background of increasingly volatile and fragmented political landscapes, pressure on courts and other institutions of scrutiny, the erosion or testing of constitutional conventions, and attempts by political actors to weaken constitutional limits in the name of electoral majorities. The comparison offered in this book therefore does not merely show how constitutional systems are designed, but also explores on how constitutional democracy may be threatened, weakened, sustained, and repaired.Each substantive part of the book has been comprehensively revised and updated to incorporate the latest legal, institutional, and political developments across the six systems.
